1. Interpretation & Definitions

Interpretation: Capitalized words in these Terms have the meanings given below, whether used in singular or plural form.

Definitions:

• Account: A profile created to access our services.
• Affiliate: Entity under common ownership or control with AstroMarketer.
• Company: AstroMarketer, registered in Maharashtra, India.
• Service: The website and related services offered at Astromarketer.in.
• Service Provider: Third-party companies providing support for service delivery (e.g., hosting, payment processors).
• User / You: Any individual or entity using the Service.

2. Services

AstroMarketer provides marketing, branding, funnel-building, ad creative, and consulting services primarily for astrologers, numerologists, healers, and spiritual practitioners. Service scope, deliverables, timelines, and fees will be agreed in writing (proposal, invoice, or campaign brief) before work begins.

3. Eligibility

You must be at least 18 years old and legally able to enter agreements in your jurisdiction to use our services. By using our services you represent and warrant that you meet these requirements.

4. Payment & Billing

All payments are processed via Razorpay unless otherwise agreed. You agree to pay all fees described in applicable proposals or invoices. Fees do not include applicable taxes which will be added where required.

• Invoice: We may issue invoices before or after project start as agreed.
• Payment Methods: Supported payment methods will be shown at checkout; Razorpay handles card, UPI and netbanking payments.
• Failed Payments: If payment fails, we may pause or stop work until payment is received.

5. Refund & Cancellation

Because our services are custom and involve time, research and creative work, refunds are limited as follows:

• Cancellation before start: You may cancel before project initiation; any advance fees will be handled per the agreement.
• After start: No refunds will be issued once meaningful work has started, except where required by law or in cases of duplicate/failed transactions.
• Duplicate/Failed Transactions: Report such issues within 3 days to Hello@astromarketer.in. Approved refunds will be processed via Razorpay within 7–10 business days.

6. Delivery & Client Responsibilities

We will deliver services per agreed timelines. Delays caused by the client (late approvals, missing materials, slow feedback) may extend delivery schedules. Clients must provide accurate information and necessary assets in a timely manner.

7. Intellectual Property

All materials created by AstroMarketer remain our property until full payment is received. Upon full payment, rights to deliverables are transferred to the client as specified in the agreement. We reserve the right to use non-confidential deliverables for portfolio and marketing purposes unless otherwise agreed in writing.

8. Confidentiality

Each party agrees to keep confidential information private and not disclose it to third parties, except to employees or service providers who need the information to perform obligations and who are bound by confidentiality obligations.

9. Third-Party Services

We may use third-party services (e.g., Razorpay, hosting, analytics). Those services have their own terms and privacy practices. We are not responsible for third-party actions or failures.

10. No Guarantee of Results

We strive for high-quality service but do not guarantee specific results, revenue, lead counts, or conversions. Campaign outcomes depend on many external factors, including platform algorithms, audience behavior, and ad spend.

11. Limitation of Liability

To the maximum extent permitted by law, AstroMarketer and its officers, employees, affiliates, and agents will not be liable for any indirect, incidental, special, consequential or punitive damages, or loss of profits or revenue, arising out of or related to the services or these Terms.

Our aggregate liability for claims arising out of or relating to these Terms will not exceed the total fees paid by you to us in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify and hold AstroMarketer and its representatives harmless from any claims, losses, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from your breach of these Terms or your use of services.

13. Termination

Either party may terminate the agreement for material breach if the breach is not cured within a reasonable time after written notice. Termination does not relieve you of obligations to pay for services performed prior to termination.

14. Privacy

Your use of our services is also governed by our Privacy Policy. By using our services you consent to the collection and use of information as described in that policy.

15. Changes to These Terms

We may modify these Terms from time to time. Material changes will be communicated by updating the "Last Updated" date. Continued use of services after changes indicates acceptance of the updated Terms.

16. Governing Law & Dispute Resolution

These Terms are governed by the laws of India. Any dispute arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of courts in Maharashtra, India.
